                    STANDING ORDER ON CERTAIN MOTIONS

 

 

 

 

1.  The parties may file evidence of an agreement to extend the time to conduct an independent medical examination and file the report pursuant to Minn. Stat. § 176.155, subd. 1.  When proper evidence of the agreement is filed and the filing date is prior to a hearing in the matter, this standing order shall be the written order granting an extension unless the compensation judge issues a contrary order.

 

2.  The parties may file evidence of an agreement to allow a medical provider to testify by deposition pursuant to Minn. Stat. § 176.155, subd. 5.  When proper evidence of the agreement is filed and the transcript of the deposition is filed on or before the hearing date or a post-hearing filing date approved by a compensation judge, this standing order shall be the order granting medical testimony unless a compensation judge issues a contrary order.

 

3.  An agreement under paragraph 1 or 2 above using the sample form provided by the Office of Administrative Hearings constitutes proper evidence of the agreement, provided that an objection is not subsequently filed.  Sample agreement forms are available at oah.state.mn.us.  Select the Workers’ Compensation Section and the link for Attorney Agreement Forms.
