
General Information
The proposed rule amendments by the Minnesota Department of Health regarding newborn screening were presented at a hearing held on January 23, 2007, before Administrative Law Judge Barbara Neilson. Judge Neilson will issue a report with respect to the proposed rules in late March. This website is intended to provide useful and timely information in the rulemaking proceeding.
As part of the rulemaking process, the testimony and some of the exhibits from the January 23, 2007 hearing, together with comments and replies submitted after the hearing will be considered in assessing the rules for need and reasonablness. A twenty-calendar-day period was set for the receipt of comments regarding the proposed rules. The initial deadline for the submission of written comments on the newborn screening rules is 4:30 p.m. on February 12, 2007.
After the period for submission of written comments ends, State law provides the agency and all interested persons an additional period of five working days for filing a written response to any comments which were submitted. Additional or new evidence may not be submitted during this five-day reply period. The five-day reply period will expire at 4:30 p.m. on February 20, 2007. Reconsideration Requested
Chief Administrative Law Judge Raymond Krause has issued his Reconsideration Order in response to the Department of Health's Request for Reconsideration .
Reconsideration Requested
The Department of Health has filed a Request for Reconsideration of Finding 67 of Judge Neilson's ALJ Report. The Department noted that all other defects found in the rules have been accepted and proposed corrections have been included in the filing. Chief Administrative Law Judge Raymond Krause will determine whether the Finding in the ALJ Report will be reconsidered.
