
The APA Division handles two distinct varieties of hearing - rulemaking and contested cases. ALJ reports in rulemaking assess the public input provided on proposed rules, determine if those rules contain defects and, if so, what can be done to cure the defects. Contested cases are hearings addressing specific disputes between identified parties. Most ALJ decisions in contested cases are recommendations to the agency involved. In those cases, the agency makes the final decision. The rulemaking reports and public decisions in contested cases are contained in a searchable Database. Those matters that are of widespread interest are also posted here to ensure that this information is readily available. Occasionally more documents from a particular matter are posted here. Individual case pages are established for those rulemaking and contested cases where widespread interest is expressed in the case and where providing briefs and other documents online serves the public interest. Please note that most of the contents of these pages are the work product of parties to litigation and such documents do not constitute the position of OAH.
