Subsurface Sewage Treatment Rulemaking

General Information

The proposed rule amendments by the Minnesota Pollution Control Agency regarding subsurface sewage treatment are scheduled for hearing on April 18 and April 20 at the following locations:

The hearings are set before Administrative Law Judge Eric Lipman. Judge Lipman will issue a report with respect to the proposed rules after public input has been received. This website is intended to provide useful and timely information in the rulemaking proceeding.

As part of the rulemaking process, the testimony and exhibits from the hearings, together with comments and replies submitted after the hearing will be considered in assessing the rules for need and reasonablness. A posthearing comment period for written commments on the proposed rule will be established at the hearings.

After the period for submission of written comments ends, State law provides the agency and all interested persons an additional period of five working days for filing a written response to any comments which were submitted. Additional or new evidence may not be submitted during this five-day reply period. Interested members of the public can e-mail, mail, fax, or deliver public comments to Judge Lipman concerning the proposed rules at:

Order Extending Rule Report Deadline

Due to the proposed MPCA modifications to the proposed rules, Chief Judge Raymond Krause has extended the deadline for the ALJ Report in this matter to August 15, 2007. The details are set out in Judge Krause's Extension Order.pdf, issued on June 8, 2007.


Public Comments

Comments received outside of the public hearings are combined into batched documents for public review [and are posted below]. The public comment period ends on February 12, 2007, at 4:30 p.m. Replies to these comments are due by 4:30 p.m. on February 20, 2007. These are "received by" deadlines, and commentators are urged to consider that when sending their comments and replies.
