ALJ Report Issued
The ALJ Report of Judge Neilson has been issued regarding the Environmental Quality Board Environmental Review Program Rules pertaining to the threshold for mandatory preparation of Environmental Assessment Worksheets for greenhouse gas emissions (Minnesota Rules Part 4410.4300, subpart 15). The Report now goes to the EQB for final adoption.
General Information
The proposed rule amendments of the Environmental Quality Board relating to the threshold for mandatory preparation of Environmental Assessment Worksheets for greenhouse gas emissions (Minnesota Rules Part 4410.4300, subpart 15) have been assigned to Judge Neilson. Judge Neilson will issue a report with respect to the proposed rules in early May. This website is intended to provide useful and timely information in connection with the rulemaking proceeding.
As part of the rulemaking process, a hearing was held on March 9, 2011, at the Minnesota Pollution Control Agency in St. Paul. During the hearing, a twenty-calendar-day period was set for the receipt of written comments regarding the proposed rules. Thus, the initial deadline for the submission of written comments in this rulemaking proceeding is 4:30 p.m. on March 29, 2011.
After the period for submission of written comments ends, state law provides the agency and all interested persons an additional period of five working days for filing a written response to any comments which were submitted during the initial comment period. New matters may not be introduced or raised during this five-day rebuttal period. The five-day rebuttal period will expire at 4:30 p.m. on April 5, 2011.
