ALJ Report Issued

The ALJ Report in the proposed rules of the Department of Human Services on the Outpatient Mental Health Services Payment Rulemaking has been issued. The rule now goes to the Department of Human Services for adoption.

General Information

The Minnesota Department of Human Services' proposed rules governing outpatient mental health payment through Minnesota’s medical assistance program (Minnesota Rules, Chapter 9505) have been assigned to Judge Sheehy. Judge Sheehy will issue a report with respect to the proposed rules in early January, 2011. This website is intended to provide useful and timely information in connection with the rulemaking proceeding

As part of the rulemaking process, a hearing was held at the Veterans Services Building in St. Paul, on November 15, 2010. Following the hearing, a deadline was set for the receipt of written comments regarding the proposed rules. The initial deadline for the submission of written comments in that rulemaking proceeding is 4:30 p.m. on November 30, 2010.

After the period for submission of written comments ends, state law provides the agency and all interested persons an additional period of five working days for filing a written response to any comments which were submitted during the initial comment period. New matters may not be introduced or raised during this five-day rebuttal period. The five-day rebuttal period will expire at 4:30 p.m. on December 7, 2010.

Interested members of the public can e-mail, mail, fax, or deliver public comments to Judge Sheehy concerning the proposed rules. Her address is as follows:
