
ALJ and Chief ALJ Reports Issued
Judge Heydinger's ALJ Report and Judge Krause's Chief ALJ Report in the proposed rules governing health risk limits for groundwater has been issued. The public exhibits, public comments, and other documents relating to these rules proposed by the Department of Health (repealing Minnesota Rules, Chapter 4717, Parts 7100 through 7400, and inserting Parts 7810 through 7900) remain available on the Health Risk Limits for Groundwater Rulemaking Proceeding Page. The rule now goes to the Department for correction of defects and adoption.
General Information
The Minnesota Department of Health's proposed rules governing health risk limits in groundwater (repealing Minnesota Rules, Chapter 4717, Parts 7100 through 7400, and inserting Parts 7810 through 7900) have been assigned to Judge Heydinger. Judge Heydinger will issue a report with respect to the proposed rules in December. This website is intended to provide useful and timely information in connection with the rulemaking proceeding.
As part of the rulemaking process, a hearing was held in St. Paul on October 10, 2008. During that hearing, a twenty-calendar-day period was set for the receipt of written comments regarding the proposed rules. Thus, the initial deadline for the submission of written comments in that rulemaking proceeding is 4:30 p.m. on October 30, 2008.
After the period for submission of written comments ends, state law provides the agency and all interested persons an additional period of five working days for filing a written response to any comments which were submitted during the initial comment period. New matters may not be introduced or raised during this five-day reply period. The five-day reply period will expire at 4:30 p.m. on November 6, 2008.
