PROTECTIVE ORDER

 

 

          Appearances:  Gregory A. Wohletz, Esq., Wohletz Law Office, 111 Riverfront Building, Suite 403, Winona MN 55987-3456, for Ryan T. Richardson (Student), and Kathryn M. Woodruff, Assistant Attorney General, 445 Minnesota Street, Suite 1200, Saint Paul, MN 55101-2130 for Winona State University (University).

 

          The parties have stipulated that this matter concerns not public data, specifically educational data pursuant to Minn. Stat. § 13.32, and have requested that the hearing in this matter be closed to the public and the hearing record sealed.  Based on the Stipulation of the parties, and pursuant to Minn. Stat. § 14.60,

 

IT IS HEREBY ORDERED:

 

1.                Disclosure of not public data is permitted in the course of this matter, but is limited to parties, counsel of record, employees assisting counsel, and representatives and witnesses of the parties to the extent necessary to prepare and present claims and defenses or as required by court order.

 

2.                The parties, counsel, representatives, or witnesses may not disclose any data encompassed by this order to persons other than those mentioned in paragraph one above.

 

3.                The hearing in this matter shall be closed, and the hearing record shall be marked and protected as not public data, as defined in Minn. Stat. § 13.02, subd. 8a.

 

4.                Should any party seek to use the information subject to this Order in a manner inconsistent with the Order, that party shall bring a motion before the Administrative Law Judge with notice to the other party, requesting permission to use the information and detailing the reasons for the request.

 

5.                This Protective Order may be modified or amended by agreement of the parties and notice to the Administrative Law Judge, or upon application to the Administrative Law Judge for good cause shown.

 

 

6.                Nothing in this Order is intended to limit review of the record by the University President.
