Robert Keena, Esq., Hellmuth & Johnson, PLLC, 10400 Viking Drive, Suite 500, Eden Prairie, MN 55344; and Alan Weinblatt, Weinblatt & Gaylord, PLC, 111 East Kellogg Blvd., Suite 300, St. Paul, MN 55101.
On October 25, 2006, Glen Posusta and Clint Herbst (Complainants) filed a Complaint with the Office of Administrative Hearings alleging violations of Minn. Stat. §§ 211B.06 and 211B.07 by Susie Wojchouski and Fred Patch in the alleged preparation and distribution of false campaign material. On November 13, 2006, the Complainants filed a Complaint with the Office of Administrative Hearings alleging the same or similar violations by Bruce and Rhonda Thielen with respect to the same campaign material.
Pursuant to Minn. Stat. § 211B.33, subd. 4, the Chief Administrative Law Judge may direct that two or more complaints be joined for disposition if the allegations in each complaint are of the same or similar character, or are based on the same act or failure to act.
After reviewing the complaints, the Chief Administrative Law Judge has determined that the allegations set forth in the first complaint (OAH Docket No. 3-6385-17601-CV) are of the same or similar character and are based on the same acts as those alleged by the Complainants in the second complaint (OAH Docket No. 3-6385-17648-CV).
THEREFORE, IT IS HEREBY ORDERED:
That the Complaint filed on November 13, 2006, by Glen Posusta and Clint Herbst against Bruce and Rhonda Thielen be joined for disposition with OAH Docket No. 3-6385-17601-CV.
