STATE OF
OFFICE OF ADMINISTRATIVE HEARINGS
|
Bob Chantland, Complainant, vs. Barbara Swanson, Wendy Manson, David Nordschow, Charles Nelson, Jeff Petersen and the Lions Club, Respondents. |
ORDER
OF DISMISSAL |
On November 3, 2005, Bob Chantland filed several Complaints with the Office of Administrative Hearings against the above named Respondents. The Complaints failed to identify which statutory provisions were allegedly violated. In addition, the Complaints were faxed to the Office of Administrative Hearings after close of business on November 2, 2005,[1] and the filing fees were not received at the Office of Administrative Hearings until November 3, 2005.
The Chief Administrative Law Judge assigned the matter to the undersigned Administrative Law Judge on November 4, 2005, under Minn. Stat. § 211B.33.
After reviewing the Complaints, the Administrative Law Judge concludes that they were filed beyond the one-year statutory limitation on filing in violation of Minn. Stat. § 211B.32, subd. 2. Minn. Stat. § 211B.32, subd. 5, specifies that complaints “must be accompanied by a filing fee of $50,” with certain exceptions not applicable here. As a result, the Complaints were not filed until November 3, 2005. Thus, the Complaints were filed more than one year after the acts that are the subject of the Complaints allegedly occurred.
Based upon the Complainant’s failure to file the complaints within the one-year statutory period,
IT IS HEREBY ORDERED:
That the Complaints are DISMISSED. The filing fee shall be returned to the Complainant.
Dated this 4th day of November 2005.
