ORDER FOR MEDIATION

WHEREAS, all parties to the above matter have consented to mediation,

THEREFORE, IT IS HEREBY ORDERED, pursuant to Minn. R. 1400.5950, that Kathleen D. Sheehy, Administrative Law Judge, Office of Administrative Hearings, P.O. Box 64620, 600 North Robert Street, St. Paul, Minnesota 55101, telephone (651) 361-7848, is appointed as mediator in this matter, and that the mediation shall be held beginning at 9:30 a.m. on May 26, 2009. It is strongly recommended that a person with authority to settle this case for each party be present during the mediation session. If that is not possible, that person shall be immediately available by telephone.

IT IS FURTHER ORDERED that, no later than May 22, 2009, each party shall file with the mediator a confidential mediation statement which shall set out (1) a brief summary of the facts and issues; (2) a description of settlement discussions to date; and (3) a list of the names and titles of persons who will attend the mediation. The mediation statement need not be served on the other party.

IT IS FURTHER ORDERED that after termination of the mediation the mediator shall forward to the agency a signed settlement agreement or, if no agreement is reached, the mediator shall inform the agency that the mediation has been terminated without agreement.
