ORDER OF AND

RECOMMENDATION

FOR DISMISSAL

 

          The above matter is before the undersigned ALJ pursuant to a Notice of and Order for Prehearing Conference and Hearing dated March 11, 2002.

          David O. Nirenstein, Esq., 100 Washington Avenue South, Suite 648, Minneapolis, MN 55401 and Manley Zimmerman, Esq., 80 S. 8th Street, Suite 4535, Minneapolis, MN 55402 represented the employee, Garry Wilson.  Gregory L. Failor, Esq., 300 South 6th Street, Suite A-400, Minneapolis, MN 55487, represented the Hennepin County Department of Community Corrections.

          On June 10, 2002 the ALJ received a request executed by Mr. Wilson and Mr. Nirenstein that this matter be dismissed with prejudice.

          NOW, THEREFORE, based upon the request for dismissal of his appeal filed by the employee,

          IT IS HEREBY RECOMMENDED AND ORDERED that this matter is dismissed with prejudice and the July 30, 2002 hearing is cancelled.
