Dear Counsel:

 

          This letter constitutes the First Prehearing Order regarding matters discussed in the telephone prehearing conference held yesterday.  Mr. Couri appeared for the City of Albertville (City); Mr. Manderscheid appeared for Hoey Outdoor Advertising, Inc. (Claimant).  After a brief discussion of the issues, we set the following schedule:

 

•October 22, 2009:                Deadline for disclosure of any new expert or third-party opinions on the propriety of costs incurred in moving the sign.

 

•October 29, 2009:                Deadline for the parties to exchange all exhibits they intend to offer into evidence, along with a witness list that contains a brief summary of the anticipated testimony of each witness.

 

•November 5-6, 2009:            Hearing, commencing at 9:30 a.m. at the Office of Administrative Hearings, 600 North Robert Street, St. Paul, Minnesota.

 

          In addition, we agreed that a deadline for the submission of post-hearing briefs would be set at the conclusion of the hearing.
