FOURTH PREHEARING ORDER |
These matters came before Administrative Law Judge Eric L. Lipman by way of correspondence from the counsel. Based upon the submissions of the parties:
IT IS HEREBY ORDERED:
1. The period for discovery shall close on Wednesday, November 25, 2009.
2. By 4:30 p.m. on Thursday, December 3, 2009, each party will file and serve copies of the pre-labeled exhibits that it proposes to offer into the hearing record. Messrs. Imdieke and Ziebell shall label their exhibits sequentially using letters. The District shall label its exhibits sequentially using numbers.
3. By 4:30 p.m. on Thursday, December 3, 2009, each party will file and serve a list of the witnesses that it intends to call at the evidentiary hearing.
4. By 4:30 p.m. on Thursday, December 10, 2009, the parties will file and serve a statement (under Minnesota Rules 1400.6950 (2) and 1400.7300 (3)) detailing any questions as to the authenticity of a pre-filed exhibit.
5. An evidentiary hearing in this matter will be held at the Saint Paul office of the Office of Administrative Hearings on Tuesday, December 15, 2009 and continue on a successive day through Wednesday, December 16, 2009.
