SCHEDULING ORDER

          A prehearing conference was held on November 15, 2007, by telephone.  Kristyn Anderson, Assistant Attorney General, 445 Minnesota Street #1100, St. Paul, MN 55101, appeared on behalf of the Department of Veterans Affairs.  Christine M. Swanson, Kelly and Fawcett P.A., 2350 UBS Plaza, 444 Cedar Street, St. Paul, MN, 55101, appeared on behalf of Petitioner.

Based on an agreement between the parties and a Request for Continuance by Respondent,

          IT IS HEREBY ORDERED: that Respondent’s Request for Continuance is GRANTED.

 

IT IS FURTHER ORDERED that:

1.                Any motions for summary disposition and accompanying memorandum shall be filed and served no later than November 30, 2007.

2.                Any responsive memoranda to any motions for summary disposition shall be filed and served no later than December 11, 2007. 

3.                Any reply memoranda shall be filed and served no later than December 18, 2007.

4.                Oral argument on any motions for summary disposition will be held at the Office of Administrative Hearings, 600 North Robert Street, St. Paul, MN 55101 on January 2, 2008.

5.                This matter is scheduled for a contested case hearing on Thursday, January 17, 2008, commencing at 9:00 at the Office of Administrative Hearings, 600 North Robert Street, St. Paul MN, 55101. 

6.                Hearings are ordinarily digitally recorded.  In the event that any party requests a court reporter, notice shall be given to the Office of Administrative Hearings no later than December 28, 2007.  See Minn. R. 1400.7400, subp. 2.

7.                Requests for subpoenas for the attendance of witnesses or the production of documents shall be made in writing to the administrative law judge pursuant to Minn. R. 1400.7000.  A copy of the subpoena request shall be served on the other parties.  A subpoena request form is available at www.oah.state.mn.us.

8.                The parties have not requested accommodation for a disability or appointment of an interpreter.  The Office of Administrative Hearings shall be notified promptly if either an accommodation or interpreter is needed.

9.                This case may be appropriate for mediation.  The parties are encouraged to consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled promptly.
