Dear Commissioner Dyrud:
I went to Redwood Falls to conduct the hearing in this matter on March 6, 2008. At the outset of the hearing, counsel for the parties informed me on the record that they intended to submit all issues, including the amount of back pay, benefits, and the merits of the wrongful discharge claim, to the hearing panel. The hearing panel was scheduled to meet that night. The parties submitted several exhibits into the record, which relate to their disagreement about the reasons for the delay in the hearing and how that might impact the back pay issues. Petitioner’s counsel requested that I keep this file open until the conclusion of the panel hearing, and that I then issue an order recommending dismissal of the petition. On April 10, 2008, I received a copy of the settlement agreement and mutual release, which the parties appear to have executed on March 19, 2008. Because the parties have resolved this matter by agreement, we are closing the file and returning it to you.
