ORDER FOR
CONSOLIDATION |
A motion to consolidate the three cases listed above was filed on August 3, 2000, by Diane M. Cornell, Associate General Counsel, Metropolitan Council, 230 East Fifth Street, St. Paul, Minnesota 55101-1626. Gregg M. Corwin, Gregg M. Corwin & Associates, P.C., 1660 South Highway 100, Suite 508E, St. Louis Park, MN 55416-1534, appeared for all of the respondents and did not object to the consolidation.
The parties have agreed to consolidation of these three matters. The Department of Veterans Affairs also supports consolidation.[1] The cases present substantially the same issues of fact and law, consolidating the cases for hearing will save time and costs, and consolidation will not prejudice any party.[2]
IT IS HEREBY ORDERED:
1. Raymond L. Golding v. Metro Transit, OAH File No.15-3100-13109-2, Donald J. Hanson v. Metro Transit, OAH File No. 15-3100-13110-2, and Howard E. Osterkamp v. Metro Transit, OAH File No. 15-3100-13111-2, are hereby consolidated.
2. A hearing on these consolidated matters is scheduled for September 11, 2000 at 9:30 a.m. at the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, MN 55401.
3. Discovery will proceed informally. In the event that the parties can not agree to the exchange of information, they should notify the administrative law judge immediately so that a prehearing conference can be held by telephone.
4. The parties shall each file an exhibit list and witness list with the Office of Administrative Hearings by September 6, 2000. To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits. A request for a court reporter shall be made no later than September 1, 2000.
