THIRD PREHEARING ORDER |
A prehearing telephone conference was held on December 21, 2000 in the above-entitled matter. Diane M. Cornell, Associate General Counsel, Metropolitan Council, 230 East Fifth Street, St. Paul, Minnesota 55101-1626 appeared on behalf of Metro Transit. Gregg M. Corwin, Gregg M. Corwin & Associates, P.C., 1660 South Highway 100, Suite 508E, St. Louis Park, Minnesota 55416-1534, appeared on behalf of the Petitioners.
IT IS HEREBY ORDERED:
1. Discovery shall be completed by February 20, 2001.
2. This matter is scheduled for hearing on February 27, 2001 commencing at 9:30 a.m. at the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, Minnesota 55401.
3. The parties shall exchange proposed exhibit and witness lists and file a copy with this office by February 23, 2001. To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits.
4. Exhibits 1-8 submitted by Respondent in support of its motion for summary disposition will be marked as Respondent’s hearing exhibits 1 through 8. Petitioner’s exhibits 1 through 10, submitted in opposition to the motion, will be marked as Petitioners’ hearing exhibits 1 through 10. Exhibits offered at hearing will be given sequential numbers at the hearing.
5. The deposition of Paul Sailor will be admitted into the record without oral reading at the hearing.
6. In the event that either side requests a court reporter, notice shall be given to the Office of Administrative Hearings no later than February 20, 2001.
7. This case may be appropriate for mediation. The parties are encouraged to promptly consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled prior to February 1, 2001.
