ORDER GRANTING MOTION FOR DEPOSITION TO
PRESERVE TESTIMONY |
On August 2, 2000, Respondent filed a Motion for Deposition to Preserve Testimony. Petitioner does not object to Respondent’s Motion. Having considered the Motion and all the documents in the file, the Administrative Law Judge makes the following:
FINDINGS OF FACT
1. That Paul Sailor is a material witness to the facts of the above-referenced case; and
2. That Paul Sailor will be unavailable at the time of the hearing because he will be more than 100 miles from the place of hearing and out of state.
IT IS HEREBY ORDERED that:
1. The deposition of Paul Sailor be taken in accordance with Minnesota Rules, Part 1400.6900, and Minnesota Rules of Civil Procedure, Rule 32.01, (c)(2), with appropriate notice to all parties; and
2. Any party may use the deposition of Paul Sailor for any purpose at the hearing in accordance with Minnesota Rules of Civil Procedure, Rule 32.01 (c)(2).
