On October 6, 2000, the Petitioner, Larry D. Krones, and the Respondent, Austin Utilities, filed a Stipulation for Dismissal With Prejudice in which they agreed by and through their respective attorneys that they had compromised and settled all of the issues raised in this matter. They further agreed that Mr. Krones’ Petition for Relief and this contested case proceeding could both be dismissed with prejudice and upon the merits and without costs, disbursements, or fees to any party.
NOW, THEREFORE, in accordance with that Stipulation, the Administrative Law Judge HEREBY RECOMMENDS:
(1) That the Commissioner DISMISS the Petitioner of Larry D. Krones with prejudice and on the merits;
(2) That the Commissioner also DISMISS this contested case proceeding with prejudice and on the merits; and
(3) That the Commissioner ORDER that both parties bear their own costs, disbursements, and fees.
