SECOND SCHEDULING ORDER

This matter came before Administrative Law Judge Manuel J. Cervantes (ALJ) on a Notice of and Order for Hearing, filed May 7, 2010. Michael A. Sindt, Assistant Attorney General, appeared on behalf of the Department of Transportation (Department). Mr. Whall (Respondent) appeared on his own behalf.

After having discussed the issues with the parties in depth at the hearing, there is no apparent dispute as to any material fact. The ALJ invited the Department to move for summary disposition. The ALJ described the motion process to Respondent and has agreed to entertain the motion. The parties agreed to the following schedule.

IT IS HEREBY ORDERED THAT:

1. No later than Friday, July 9, 2010, the Department shall file its Notice of Motion and Motion with the Office of Administrative Hearings and provide a copy thereof to the Claimant.

2. No later than Friday, July 23, 2010, 2009, the Claimant shall file his written response with the Office of Administrative Hearings, 600 Robert Street North, St. Paul, MN 55164 and provide a copy thereof to the Department.
