 PREHEARING ORDER

          A prehearing conference was held by telephone on September 13, 2000. R. Gordon Nesvig, Attorney at Law, Box 255, Cottage Grove, MN 55016, the Petitioner, appeared on his own behalf.  John Bannigan, Jr., Attorney at Law, 17850 North Central Life Tower, 445 Minnesota Street, St. Paul, MN 55101, appeared on behalf of Grey Cloud Island Township.  Barry Sitlow, City Administrator, St. Paul Park City Hall, 600 Portland Avenue, St. Paul Park, MN 55071, appeared on behalf of the City of St. Paul Park.  Ryan Schroeder, City Administrator, Cottage Grove City Hall, 7516 - 80th Street South, Cottage Grove, MN 55016, appeared on behalf of the City of Cottage Grove.

IT IS HEREBY ORDERED:

1.      This matter is scheduled for hearing on October 17, 2000, commencing at 9:30 a.m. at the City Council Chambers, St. Paul Park City Hall, 600 Portland Avenue, St. Paul Park, MN.  The following additional days of hearing have been scheduled: October 18, 20, 23, 24 and 25, 2000. 

2.      The parties shall exchange witness lists and proposed exhibits and file a copy of the lists with this office by October 10, 2000.  To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits.

3.      The witness lists shall identify persons expected to be called as expert witnesses, and include a statement describing the subject matter of the expected testimony, the substance of the facts and opinions to which the expert is expected to testify, and a summary of the grounds for each opinion.  A copy of the curriculum vitae and any report prepared in this matter by the expert shall be served on the parties and filed with this office by October 10, 2000, along with the witness list and statement.

4.      The Notice of Hearing will be prepared by this office, served on the parties, and delivered to the Petitioner for publication in the The South Washington County Bulletin on October 4, 2000, and October 11, 2000, the two successive weeks prior to the hearing, as required by Minn. Stat. §414.09, subd. 1 (1998).

5.      Pursuant to Minn. Laws 2000, Ch. 446, the parties to this case must pay the costs of the hearing process in the proportions they agree to.  If the parties cannot agree on a division of the hearing costs before the commencement of the hearing, the costs must be allocated on an equitable basis by the chief administrative law judge.  At least 10 working days before the start of the hearing, October 3, 2000, the parties must file their agreement on hearing costs with the chief administrative law judge or, if no agreement is reached, they must file their written argument on the appropriate allocation of costs.  Notice to this effect will be included in the Notice of Hearing.

6.      By October 12, 2000, the parties will notify this office if the services of a court reporter are required for the hearing or any portion of it.

7.      Requests for subpoenas for the attendance of witnesses or the production of documents shall be made in writing to the administrative law judge pursuant to Minn. R. 1400.7000 (1999).
