INTERVENTION OF CONAGRA, INC. |
The above-entitled matter is before the Administrative Law Judge on the Petition to Intervene of ConAgra, Inc.
Appearances: Kevin L. Grady, Business Group Manager, ConAgra Energy Services Company, Nine ConAgra Drive, P.O. Box 3200, Department CIG3200, Omaha, Nebraska 68103-0200, appeared on behalf of ConAgra, Inc. There was no opposition to the petition received from any of the existing parties.
Based upon the record herein and for the reasons set forth in the following Memorandum, the Administrative Law Judge makes the following:
ORDER
1. The Petition to Intervene of ConAgra, Inc. is GRANTED.
2. ConAgra, Inc. shall be allowed to participate in these proceedings as a party with regard to the issue of rate design, particularly with respect to the Rate 525 Service Class.
IT IS SO ORDERED.

MEMORANDUM
ConAgra,
Inc. filed a Petition to Intervene on August 11, 1995. ConAgra, Inc. is a parent company of
Freeborn Foods of Albert Lea, Minnesota.
It appears from the
petition that Freeborn Foods is the only customer of Interstate Power Company currently being served under Rate Schedule 525.
It appears that Freeborn Foods’ legal rights may be determined or affected by this case, that the impact will be significant and direct, that its rights are not adequately represented by the existing parties, and that its petition was timely. Therefore, ConAgra, Inc. meets the requirements for intervention as a party as set forth in Minn. R. 1400.6200 and it should be allowed to participate in this proceeding with regard to the issue in which it has an interest, namely, the rate design, particularly as it affects Rate Schedule 525.
