I have also received a request from NoCapX, U-CAN and NoRCA for subpoenas for two state employees. I am reluctant to subpoena state employees if they are willing to testify. Ms. Overland, would you please let me know if you have made efforts to obtain the cooperation of the witnesses. If they refuse to appear without a subpoena, I will consider your request. If there is a need to set a definite time for their testimony, we can discuss that when all parties are present at the public hearings. I am sure we can find a time that will be mutually agreeable.
It would be helpful if all parties who prefiled testimony would appear at the first public hearing about 30 to 45 minutes before it convenes so that the prefiled testimony can be marked by the court reporter. I will ask each party to offer that testimony at the start of the public hearing, and it will be received absent objection from any party. If there is an objection, the testimony will not be

received until the objection can be addressed at the evidentiary hearing.
