In re:  In the Matter of the Application for a Route Permit for the Fargo to St. Cloud 345 kV Transmission Line Project

          OAH 15-2500-20995-2; PUC No. E-002/TL-09-1056

Dear Ms. Agrimonti and Ms. Hammel,

In reviewing the record in this case, I am unable to reconcile the evidence offered by the Applicants with the information in the DEIS for the number of residences affected by the Modified Preferred Route in the North Dakota to Alexandria portion of the route.  The  figures from Lahr Rebuttal, Schedule 8, restated in the  Applicants’ Post-Hearing Brief at 35, are significantly different from those included in the DEIS at 5-11, Table 5.1-10.

Also, the text in the paragraph immediately preceding DEIS Table 5.1-10 states that the table “shows the number of residential and nonresidential structures within 500-feet of the proposed ROW centerline for each route.”  Yet the table does not appear to include nonresidential structures.

If you have information to clarify these points, I would appreciate it if you would provide it to me, and e-file it so that the other parties will have the opportunity to review it.  If the response requires information from outside the record, please submit it as a sworn affidavit.

                                                                      Sincerely,
