Lisa M. Agrimonti, Briggs and Morgan, P.A., appeared on behalf of Northern States Power Company and Great River Energy (Applicants). 

Karen Finstad Hammel, Assistant Attorney General, appeared on behalf of the Department of Commerce, Office of Energy Security, Energy Facility Permitting Staff (Department).

On April 1, 2010, the Applicants notified the Administrative Law Judge that neither the notices and affidavits of the Applicants’ mailings and publication, nor the notices and affidavits of OES’s notice to landowners concerning the alternative routes included in the Scoping Decision were offered into evidence during the contested case proceeding.  The documents were previously filed with the e-docket system.

The Applicants and OES request that the documents be accepted into the contested case record.

IT IS HEREBY ORDERED:

1.       The Applicants shall provide the Administrative Law Judge with a hard copy of the Affidavits of Mailing and Publication, E-docket Document No. 20095-37264-01 (filed May 7, 2009), which shall be marked as Exhibit 30 and added to the hearing record.

2.       OES shall provide the Administrative Law Judge with a hard copy of the OES Notice to Landowners on Alternative Routes, E-Docket Document No. 200910-43298-01 (filed October 28, 2009), which shall be marked as Exhibit 31 and added to the hearing record.
