ORDER GRANTING INTERVENTION TO MIDTOWN PHILLIPS NEIGHBORHOOD ASSOCIATION AND EAST PHILLIPS IMPROVEMENT COALITION

 

 

 

          On January 20, 2010, Midtown Phillips Neighborhood Association, Inc. (Midtown Phillips) and East Phillips Improvement Coalition (East Phillips) each filed a Petition to Intervene in this proceeding pursuant to Minn. R. 1400.6200. 

 

In support of its petition, Midtown Phillips stated that it is designated by the City of Minneapolis as the citizen participation organization for the Midtown Phillips Neighborhood of Minneapolis.  As such, it has a role in the planning, funding and implementation of projects that will benefit the city and the neighborhood.  The neighborhood’s boundaries are Chicago Avenue on the west, Bloomington Avenue on the east, East 24th Street on the north and East Lake Street on the south.  This 48-block area includes three of the four proposed power line routes addressed in this proceeding.  Midtown Phillips has participated in the city’s Midtown Land Use and Development Plan and is engaged with the 20-year city planning project for the Chicago Corridor, which intersects with three of the proposed routes.  Midtown Phillips is concerned that the routing of this project may adversely affect the interests of its members and planning for the area.  It implies in its petition that the current parties to the proceeding will not fully represent its interests.

 

In support of its petition, East Phillips stated that it is designated by the City of Minneapolis as the citizen participation organization for the East Phillips Neighborhood of Minneapolis.  The neighborhood’s boundaries are 24th Street on the north, Highway 55 on the east, Lake Street on the south and Bloomington Avenue on the west.  Its proximity to the proposed route alternatives and the location of the east substation may have a significant impact on property value and future economic development, and East Phillips is concerned about the possible health effect on the persons residing in the neighborhood.  It implies in its petition that the current parties to the proceeding will not fully represent its interests.

 

The current parties to this proceeding, the Applicant (Northern States Power Company), the Office of Energy Security, Midtown Greenway Coalition, City of Minneapolis, Crew2, Inc., Hennepin County, Little Earth of United Tribes, Longfellow Community Council, Seward Neighborhood Group, Inc., Corcoran Neighborhood Organization, Phillips West Neighborhood Organization and Wells Fargo Bank, have not filed an objection to either Petition for Intervention within seven days of service of the petitions.

ORDER

          IT IS HEREBY ORDERED:

1.               Midtown Phillips’ and East Phillips’ Petitions to Intervene as a party with full rights are GRANTED.  Each one shall be subject to the provisions of the Prehearing Order issued on August 11, 2009, and the Revised Scheduling Order filed on December 7, 2009.

2.               Midtown Phillips’ and East Phillips’ representatives shall be added to the OAH Service List.
