SECOND PREHEARING ORDER

The parties are engaged in productive settlement discussions and have requested a modification of the schedule established in the First Prehearing Order. They propose that all subsequent filing and hearing dates be continued indefinitely to allow the parties to continue settlement discussions. The parties will report the status of their discussions by September 28, 2009.

The Administrative Law Judge finds that the parties’ request is reasonable.

ORDER

It is hereby ordered that the schedule in this matter is continued indefinitely and that the parties report the status of their settlement discussions to the Administrative Law Judge by September 28, 2008.
