In the Matter of the Petition of McLeodUSA for Commission Mediation of a Dispute with Qwest Pursuant to 47 U.S.C. § 252(a)(2)

MEDIATION ORDER

WHEREAS, the Minnesota Public Utilities Commission has referred this matter to the Office of Administrative Hearings for mediation, based upon the consent of all parties to mediate the above matter,

THEREFORE, IT IS HEREBY ORDERED, that the mediation shall be held on July 12, 2007, beginning at 9:30 a.m., at the offices of the Department of Commerce, Sibley and Snelling Conference Rooms, 85 Seventh Place East, Suite 500, St. Paul, MN 55101.

It is suggested that each party file with the mediator by the close of business on July 10, 2007, a confidential mediation statement which shall set out (1) a brief summary of the party’s position on the template issue and any alternatives to these positions the parties have offered in the course of negotiations, and (2) a list of the names and titles of person(s) who will attend the mediation. The mediation statement need not be served on the other party. The person with authority to settle this case for each party must be present.

IT IS FURTHER ORDERED that after termination of the mediation the mediator shall forward to the agency a signed settlement agreement or, if no agreement is reached, the mediator shall inform the agency that the mediation has been terminated without agreement.
