In the Matter of the Petition of McLeodUSA for Commission Mediation of a Dispute with Qwest Pursuant to 47 U.S.C. § 252(a)(2)

SECOND AMENDED MEDIATION ORDER

WHEREAS, a mediation session is scheduled to be held on July 27, 2007, beginning at 9:30 a.m., at the offices of the Department of Commerce, 85 Seventh Place East, Suite 500, St. Paul, MN 55101; and

WHEREAS, McLeodUSA and Qwest have advised the undersigned Administrative Law Judge that (1) the parties have agreed in principle on a starting point for the negotiation of a replacement interconnection agreement (ICA); (2) the parties have agreed to extend the date on which the arbitration window under the Act opens by 120 days from the date McLeod USA receives Qwest’s complete proposal for all sections of the ICA; (3) in an effort to meet the new negotiations window, the parties will establish a regular schedule of two negotiation sessions per week, subject to vacation, illness, or other circumstances; and (4) the parties desire a continuance of the mediation session pending the implementation of the agreed-upon terms;

THEREFORE, IT IS HEREBY ORDERED, that the mediation scheduled to take place on July 27, 2007, is continued indefinitely. The parties shall notify the ALJ when the process outlined above has been implemented so that the mediation file may be closed and returned to the Commission.
