A telephone prehearing conference was held before Administrative Law Judge Richard C. Luis, on March 16, 2007, at 11:00 a.m.

Discussion was held among the participants concerning the proposed schedule, what discovery remained outstanding, what date would be appropriate for holding the evidentiary hearing and what notice to the public was needed regarding the new date for that hearing. The Administrative Law Judge makes the following Prehearing Order.

The April 12, 2007 evidentiary hearing will
begin on April 12, 2007, at 9:30 a.m. in
the Small Hearing Room at the Public
Utilities Commission in
7. As noted in the First Prehearing Order, prefiled testimony will be designated and received as hearing exhibits. Counsel should have a paper copy of each exhibit that has been E-filed for use by the witness and an additional copy for the ALJ. The sponsoring party will provide the unique E-file system identifying number of the prefiled document and the Administrative Law Judge will assign a hearing exhibit number to that document.[1] The paper copy is for use at the hearing and will not constitute the record copy. Any document that is offered as an exhibit that has not been E-filed will be identified as the record copy. After the hearing, OAH staff will prepare a hearing exhibit list that notes whether the exhibit is paper or E-filed and allow for direct access to the E-filed exhibits.
