Dear Parties:
In response to my last request on November 19, 2007,
for an update on the status of the parties’ settlement discussions, Ms. Moore indicated
that Interstate Power and Light is currently serving Heron Lake Bioenergy and provided me with a copy of the service
agreement between Interstate and Heron Lake Bioenergy. No other party provided any information in response
to my request.
Based upon the information provided by Ms. Moore, it
appears likely that some of the issues raised in the Joint Petition have been
resolved. However, Federated was not a
signatory to the agreement provided by Ms. Moore, and it is not clear to me
whether Federated or any other party has any remaining issues they wish to
assert in this case. Please inform me as
soon as possible whether any issues remain for determination in this case. If I do not receive any such information by February 11, 2008, I will assume that
no further issues remain for hearing in connection with the Joint Petition and
I will close the OAH file and return the official record to the Public
Utilities Commission with a recommendation that the matter be dismissed.
