In the Matter of the Complaint of PrairieWave Communications, Inc. (fka McLeodUSA) Against Qwest Corporation Regarding the Payment of Switched Access Charges

SECOND PREHEARING ORDER

           

Since the time of the First Prehearing Order issued on October 28, 2002, the parties have been negotiating in an attempt to resolve or at least significantly narrow this proceeding.

The parties have collectively requested a continuance in the schedule to determine whether or not negotiations can be successfully concluded.  No party or participant has objected to this proposal.

Based on the foregoing, the Administrative Law Judge makes the following:

ORDER

1.               Paragraph 4 of the First Prehearing Order is hereby amended to read as follows:

Direct Testimony shall be filed by February 18, 2003.

Rebuttal testimony shall be filed by March 24, 2003.

Surrebuttal testimony shall be filed by April 21, 2003.

2.               Paragraph 7 of the First Prehearing Order is amended to read as follows:

The evidentiary hearing shall begin on May 5, 2003, and continue so long as necessary.

3.               All the rest and remainder of the First Prehearing Order, not modified above, shall remain in effect.
