THIRD LINE SHARING OVER DLC PREHEARING ORDER

This matter came on for telephone conference before Administrative Law Judge Steve M. Mihalchick on August 20, 2002.  The following persons noted their appearances at the conference:

Stephen Bowen and Anita Taff-Rice for Covad.  Norton Cutler for Qwest.  Steve Alpert, Assistant Attorney General, Edward Fagerlund, Economist, and Wes Legursky, Consultant, for the Department of Commerce.

          Based upon agreements reached during the conference, the Administrative Law Judge makes the following Order:

ORDER

          The following schedule is adopted:

 

1.  September 24, 2002 - All parties file testimony regarding all issues other than pricing. 

2.     October 15, 2002 – All parties file responsive testimony.

3.     October 25, 28-30, 2002 – 9:00 a.m. hearing at PUC hearing rooms.

4.     November 20, 2002 – Briefs.

5.     December 13, 2002 – ALJ report on issues other than pricing.

6.     Filings and hearing on pricing issues will be scheduled later.

MEMORANDUM

 

          Following the August 20th conference, the Administrative Law Judge spoke with Marc Fournier of the Commission staff regarding the need to complete this docket within the Qwest 271 Application time lines.  He stated that staff and the Commission recognize that it would be impossible to do so.  He also suggested that it would not be necessary to set interim pricing.
