In the Matter of the Application of Northern States Power Company d/b/a Xcel Energy for Certificates of Need for Four Large High Voltage Transmission Line Projects in Southwestern Minnesota

ORDER EXTENDING DEADLINE TO  PREFILE TESTIMONY – PUBLIC INTERVENORS NETWORK

            On April 11, 2002, the Public Intervenors Network filed a motion to extend the time to prefile its direct testimony.  It requested the extension in order to obtain the expert opinion of David Schoengold, and, if funds are available, Art Hughes.  Xcel Energy opposed the motion because it was made on the day that the prefiled direct testimony was due, and the moving party had not proceeded promptly to retain its expert.  Also, late submission of prefiled testimony will hamper Xcel Energy’s preparation for hearing. 

            Carol A. Overland, Esq., Overland Law Office, P.O. Box 559, Red Wing, MN 55066, appeared on behalf of the Public Intervenors Network.  Michael C. Krikava, Esq., Briggs and Morgan, P.A., 80 South Eighth Street, Suite 2400, Minneapolis, MN 55402, appeared on behalf of Xcel Energy.

             

            IT IS HEREBY ORDERED:

1.               The deadline for the Public Intervenors Network to file the direct testimony of David Schoengold, and Art Hughes if he is retained, is extended.  Public Intervenors Network shall arrange for personal delivery of the direct testimony to Xcel Energy and the Department of Commerce, and file a copy with the judge no later than 12:00 noon on April 30, 2002.  Efforts shall be made to assure delivery to all other parties that day.

2.               In the event that any party is disadvantaged by the lateness of the Public Intervenors Network filing of direct testimony, the matter will be addressed at the prehearing conference scheduled for May 1, 2002 and necessary adjustments made to the hearing schedule.
