NINTH PREHEARING ORDER

These matters are before Administrative Law Judge Steve M. Mihalchick to establish procedures to resolve two open matters, amendment of the list of elements to be priced and Lakedale Link’s objection to provision of CLEC specific data to the Department of Commerce and the Office of Attorney General.

SCHEDULE FOR MOTION TO AMEND PRICING LIST

1.               Any additional parties seeking to reply to Qwest’s Motion to Amend the List of Elements in the UNE Pricing docket (1375), shall file that reply by January 9, 2002. The issues will be addressed in a telephone conference to be held on January 11, 2002, at 1:30 p.m. CST. Mr. Topp’s conference bridge will be used; call 877-582-8687 and enter conference number 8277949 when requested.

SCHEDULE FOR CLEC-SPECIFIC INFORMATION ISSUES

2.               Lakedale Link filed an objection to Qwest providing disaggregated CLEC-specific information to the State agencies involved in this matter.  A copy of the objection is attached. That objection did not provide the reasons for the objection or why limiting provision of that information only to state agencies, subject to the laws and orders prohibiting its public disclosure, was inadequate.  Lakedale Link, the Department, and the OAG shall file brief comments with the Office of Administrative Hearings regarding this issue by January 10, 2002.  Any other interested party may also do so by that date.  The January 11, 2000 telephone conference will begin with a discussion of this issue and Lakedale Link is invited to participate in the telephone conference.
