These matters were scheduled for telephone prehearing conferences before Administrative Law Judge Richard C. Luis on June 14, 2002 and Administrative Law Judge Steve M. Mihalchick on June 12, 2002. The conference before Judge Luis was cancelled due to agreement of the parties on the issues to be discussed. The conference before Judge Mihalchick was conducted by telephone.
1. The Department of Commerce requested modification of the schedule in the OSS docket (1371) in order to accommodate the schedule of attorneys and staff committed to the Commission’s scheduled oral argument and deliberations in the Separate Affiliate docket (1372) on July 9, 2002, the date scheduled for commencement of the 1371 hearing. Prior to the telephone conference, Qwest agreed to proposed schedule changes for the docket, proposing to move Qwest’s filing date with the FCC to September 17, 2002.[1] Qwest’s Reply filing is due June 28 and Surrebuttal is due July 10, 2002. The hearing will begin July 15 and continue through July 25, 2002. The anticipated date for the ALJ Report is August 30, 2002. The agreed-upon dates are adopted and incorporated in the attached schedule.
2. In the June 12, 2002 telephone conference, Judge Mihalchick ordered that the schedule in the DLC-Line Sharing docket (293) be changed to schedule a telephone conference on June 19, 2002, at 2:00 p.m. CDT for the outstanding motion to compel. The existing due date for all parties’ responses is changed from July 5 to July 12, 2002. These dates are incorporated in the attached schedule.
3. Barbara M. Ross has withdrawn as counsel for Popp Telecom. The parties should remove Ms. Ross’ address from the nonproprietary paper filing service list. The list for email should have the address bross@bestlaw.com removed. Service on Popp Telecom is to be made directly on the party at 620 Mendelssohn Avenue N., Golden Valley, Minnesota 55427. An updated service list accompanies this Order.
