FOR APPROVAL OF SETTLEMENT AGREEMENT |
The above-entitled matter is before Administrative Law Judge Steve M. Mihalchick upon request of the parties that an agreement resolving the matter be approved.
In an Agreement dated February 19, 1997, a copy of which is attached hereto (the Agreement), Freeborn-Mower Electric Cooperative (Freeborn-Mower), Interstate Power Company (Interstate) and Exol Corporation (Exol) resolved the issues in this matter. A copy of the Agreement was filed with the Administrative Law Judge on March 11, 1997. Under the Agreement, Interstate withdraws its objection to the joint petition of Freeborn-Mower and Exol and the parties agree to specific further adjustments of their service territory boundaries and other terms and conditions.
On March 28, 1997, the Department of Public Service notified the Administrative Law Judge that it had reviewed the Agreement, found nothing objectionable in it, and joined in the request that the matter be referred back to the Commission with a recommendation of approval.
Having reviewed the Agreement, and finding it to be reasonable, the Administrative Law Judge makes the following:
RECOMMENDATION
IT IS HEREBY RESPECTFULLY RECOMMENDED that the Minnesota Public Utilities Commission approve the Agreement of April 19, 1997.
