          RE:     Proposed Revocation of the Private Detective License of

                    Thomas J. Bicanich; OAH Docket No. 7-2403-13175-2

Dear Mr. Bicanich and Mr. Pahl:

          Please allow this letter to update you on the status of this case.  A hearing was scheduled in this matter on Monday, January 8, 2001, commencing at 9:30 a.m. at the Office of Administrative Hearings in Minneapolis.  The Licensee, Thomas J. Bicanich, did not appear.  I subsequently discussed the status of the case with Mr. Pahl, who informed me that the Licensee had been served with the Notice of and Order for Hearing at his last known address (same as above) on November 17, 2000.

          In most situations involving contested case proceedings such as this, whenever a licensee has been served with proper notice and does not appear without contacting the licensing agency, the Assistant Attorney General representing the agency or the Administrative Law Judge, the licensee loses by default.  Mr. Pahl informed me, however, that the circumstances of this case are different, and he did not make a motion for a default judgment.  After the time for convening the hearing passed, Mr. Pahl explained that the Licensee, who contacted the agency and alleged that he was about to obtain the statutorily-required surety bond, may have had reason to believe that it was unnecessary to appear for the hearing on January 8, 2001.  As a result, Mr. Pahl moved for a CONTINUANCE of this matter, and his Motion is GRANTED.

          IT IS ORDERED that the Evidentiary Hearing in the above matter is CONTINUED from January 8, 2001 to 9:30 a.m. on Tuesday, January 16, 2001 at the Office of Administrative Hearings, Suite 1700, 100 Washington Square Building, Minneapolis, Minnesota.  The 100 Washington Square Building is on Washington Avenue between Marquette and 2nd Avenue South.

          If this matter is not settled before then (such as by way of Mr. Bicanich’s obtaining appropriate, required bonding), I look forward to seeing you at 9:30 a.m. on January 16, 2001.  Mr. Bicanich is reminded that should he fail to appear for the hearing at the time, place and on the date scheduled, without the prior permission of the Administrative Law Judge, the allegations contained in the Notice of and Order for Hearing may be taken as true.
