Dear Ms. Kvalseth and Ms. Williams:
This letter constitutes the Prehearing Order concerning matters discussed in the prehearing conference on December 12, 2003. Ms. Kvalseth appeared on behalf of the Crime Victims Reparations Board; appearing with her was Marie Bibus, Director of the Board. Angela Williams appeared for herself without counsel; appearing with her were her parents, Robert and Monica Buboltz. Mr. Buboltz is the conservator of Ms. Williams and her estate.
During the prehearing conference the parties outlined their respective positions. I provided to Ms. Williams and her family the Guide to Participating in Contested Case Proceedings and other materials from the OAH website (Pro Se Guide, Witness Guide, and instructions for obtaining and serving subpoenas). Other materials, including the rules of the OAH, are available on the website at www.oah.state.mn.us. I encourage Ms. Williams and her family to review these materials well before the hearing.
The following schedule was set:
January 30, 2003: Date by which parties will exchange exhibits and witness lists. Witness lists shall contain a summary of the anticipated testimony for each witness.
February 6, 2003: Hearing, 9:30 a.m., Office of Administrative Hearings.
After the prehearing conference, the parties engaged in settlement discussions, and I encourage them to continue those discussions up through the date of hearing. If the matter is resolved before then, please advise me immediately.
