CHIEF ADMINISTRATIVE LAW JUDGE’S ORDER ON REVIEW OF RULES

         

          The Minnesota Department of Public Safety (“Agency” or “Department”) has proposed the above-entitled rules for adoption.  On April 21, 2004, the Office of Administrative Hearings conducted a public hearing regarding the rules.  On June 3, 2004, the Administrative Law Judge issued the Report on the rules pursuant to Minn. Stat. § 14.15 and Minn. R. 1400.2240.  As set forth in the June 3, 2004 Report, the following provisions of the rules were disapproved as not meeting the requirements of Minnesota Rules Part 1400.2100, item B: 7406.2700.

 

          Based upon a review of the written submissions and filings, Minnesota Statutes, Minnesota Rules, and the June 3, 2004 Report of the Administrative Law Judge,

 

          IT IS HEREBY ORDERED: that the findings of the Administrative Law Judge in the June 3, 2004 Report of the Administrative Law Judge are approved.  The reason for the disapproval of the rule, and the suggested correction to cure the defect found, are as set forth in the attached Report.
