In the Matter of Petition to Annex Territory Into Shorewood Park Sanitary District

RECOMMENDATION FOR DISMISSAL

This matter was commenced by a Notice of and Order for Hearing issued by the Pollution Control Agency on April 10, 2000. The proceeding was initiated in response to a petition filed by the Shorewood Park Sanitary District and the Township of Nessel for approval of the annexation of a specified area adjacent to the Shorewood Park Sanitary District. The proceeding was postponed while those bodies reconsidered the matter. Both bodies subsequently determined that the annexation petition was not supported by a substantial number of their residents and property owners. A joint resolution of the Sanitary District and the Township adopted July 11, 2000 has been provided to the Administrative Law Judge in which the Township withdraws its prior resolutions and requests that the PCA terminate all proceedings in the matter.

Based upon the withdrawal of the Petition, the Administrative Law makes the following:

RECOMMENDATION

IT IS HEREBY RESPECTFULLY RECOMMENDED that the Pollution Control Agency dismiss the Petition of Nessel Township to Annex Territory Into Shorewood Park Sanitary District.
