FIRST PREHEARING ORDER

A prehearing conference was held on February 22. 2000 at the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, MN 55401. Cheri Sudit, Assistant Hennepin County Attorney, 300 South Sixth Street, Suite A-2000, Minneapolis, MN 55487, appeared for the County. Aaron T. Stone, Strandemo & Sheridan, PA, 320 Eagandale Office Center, 1380 Corporate Center Curve, Eagan, MN 55121, appeared for Frank A. Lonergan.

IT IS HEREBY ORDERED:

1. This matter is scheduled for hearing on April 24, 2000, commencing at 9:30 a.m. at the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, MN 55401. The parties shall exchange proposed exhibit and witness lists, and file copies with this office by April 17, 2000. To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits.

2. The Employer, Hennepin County, has given Mr. Lonergan notice of his right to a hearing pursuant to Minn. Stat. §197.46 (1998). The Employee has waived his right to a hearing before the Hennepin County Human Resources Board and agreed that this Office shall conduct the hearing. A Waiver of Right to Veterans Preference Hearing Before the Human Resources Board has been signed by Mr. Lonergan, his counsel, and the Assistant County Attorney and filed with this Office. The Recommendation of this Office will be sent to the Hennepin County Human Resources Board for review and a final decision.
