In Re the License of the St. Paul Firearms Co., 634 Snelling Avenue North, St. Paul, Minnesota

ORDER

           

            By a letter dated June 4, 1996, the Hamline-Midway Neighborhood Stability Coalition (HMNSC) seeks a stay of the hearing in the above matter scheduled for June 11, 1996.  Replies to the Motion were filed by the City of St. Paul (City) on June 5, 1996, and by the St. Paul Firearms Co. (SPFC) on June 6, 1996.

            The Hamline-Midway Neighborhood Stability Coalition is represented by Richard D. Snyder, Esq., Fredrikson & Byron, P.A., 1100 International Centre, 900 Second Avenue South, Minneapolis, Minnesota  55402.  The City of St. Paul is represented by Philip B. Byrne, Assistant City Attorney, 400 City Hall, 15 West Kellogg Boulevard, St. Paul, Minnesota  55114.  The St. Paul Firearms Co. is represented by Christopher J. Dietzen, Esq., Larkin, Hoffman, Daly & Lindgren, Ltd., 1500 Norwest Financial Center, 7900 Xerxes Avenue South, Bloomington, Minnesota  55431.

            Based upon the filings and for the reasons set out in the following Memorandum,

            IT IS HEREBY ORDERED:

            1.         That the hearing in the above matter is continued indefinitely pending action by the Minnesota Court of Appeals.

            2.         The question of the party status of the Hamline-Midway Neighborhood Stability Coalition shall be determined later upon filing of a Petition to Intervene.

MEMORANDUM

The Hamline-Midway Neighborhood Stability Coalition filed a Petition for a Writ of Prohibition with the Minnesota Court of Appeals on May 30, 1996, seeking to have the City prohibited from further proceedings on St. Paul Firearms Co.’s license. Hamline-Midway Neighborhood Stability Coalition was a party to the prior license proceeding involving St. Paul Firearms Co.  It is a potential intervenor in this proceeding.  Both the City and the Licensee agree that it is reasonable to continue this administrative hearing pending a disposition by the Court of Appeals.

Since this hearing may not be held, depending on the determination by the Court, it is reasonable to defer any determination as to the party status of the potential intervenor, Hamline-Midway Neighborhood Stability Coalition.
