Dear
Colonel Konrad:
Please allow this letter to confirm
the outcome of a Prehearing Conference conducted in this matter on December 30,
2010, which conversation included the undersigned Administrative Law Judge,
Conservation Officer Brian Dobbick, and Dale P. LaRoche.
The parties agreed that the property
upon which Mr. LaRoche allegedly trespassed was not posted properly, and
Conservation Officer Dobbick agreed to request that Civil Citation #155931,
issued against Mr. LaRoche on October 12, 2010, be rescinded.
On January 18, 2011, the
Administrative Law Judge received the enclosed letter requesting rescission of
the Citation from Conservation Officer Dobbick.
Therefore, IT IS RECOMMENDED
that Civil Trespass Citation #155931, issued to Dale P. LaRoche on October 12,
2010, be RESCINDED.
This Office’s file in the matter is
now closed. The official record is
returned to you herewith, along with Conservation Officer Dobbick’s letter
requesting rescission of the Citation.
