Dear Commissioner Holsten:
On July 16, 2007, a Prehearing Conference was held in this matter by telephone. Jeffrey Alan Johnson and Conservation Officer Matt Frericks participated. During the Prehearing Conference, the parties agreed to submit the matter to me for a decision without further hearing in order to resolve the matter, and they each affirmed that the facts as stated to me were true.
On or about July 17, 2007, I received a telephone call from Conservation Officer Matt Frericks. Officer Frericks explained (via voice mail) that, after taking the entirety of the circumstances into consideration, that he was withdrawing the citation against Mr. Johnson (Citation Number 142852).
As a result of the withdrawal of the citation, I am closing this Office’s file in the matter and returning the record to you.
