constitutes the First Prehearing Order concerning matters discussed in the
prehearing conference held yesterday.

During the conference we set the following schedule:
February 21, 2007: Deadline for filing any Petition for Intervention;
Deadline for filing any objection, pursuant to Minn. R. 1400.6200, to the Petition for Intervention served by the St. Croix River Association on February 14, 2007.
March 15, 2007: Deadline
for filing prehearing briefs on behalf of Mr. Hubbard and the City of
March 22, 2007: Deadline for parties to exchange all exhibits they intend to offer into evidence at the hearing and witness lists; witness lists shall include a brief
summary of the anticipated testimony for each witness. Copies of the exhibit lists and witness lists shall be provided to the Administrative Law Judge.
March 27, 2007: Deadline
for filing prehearing briefs on behalf of the Department and
March 29-30, 2007: Hearing,
commencing at 9:30 a.m. at the
April 6, 2007: Deadline for filing simultaneous post-hearing briefs.
