Dear Counsel:
This
letter will confirm our discussions during our conference call yesterday morning
and constitutes the Second Prehearing Order of the Administrative Law Judge in
this matter. Due to the recent death of
Mr. Bondhus, there is good cause for a continuance of the schedule set forth in
the First Prehearing Order. Paragraphs
Two and Three of that Order are hereby modified to state that all discovery in
this matter shall be completed by January 31, 2007; all dispositive motions shall
be served and filed by February 14, 2007; responses in opposition to such
motions shall be served and filed by February 28, 2007; and reply briefs with
respect to such motions shall be served and filed by March 7, 2007. The motion argument date set forth in Paragraph
Four of the First Prehearing Order shall be stricken at this point.
A
status conference shall be held by telephone conference call on Wednesday, December 20, 2006, at 10:30 a.m. To participate in the call, please dial 1-888-942-8516 at 10:30 a.m. and enter

adjustments in the schedule and set new dates for motion argument, exchange of
exhibit and witness lists, and the hearing in this matter.
