RE: In the Matter of the Notice of Trespass Violation, Civil Citation and Imposition of Penalty; OAH Docket No. 6-2000-11507-2
Gentlemen:
A prehearing conference telephone call in this matter was held on the afternoon of Thursday, February 19. Participating in the call were the undersigned Administrative Law Judge, Mr. Elalami and Officer Dan Book.
In the course of the conference call, we discussed the facts of the matter, which were undisputed. The long and short of the matter is that the land was posted, but Mr. Elalami did not see the signs, and entered onto the land. He had no intent to trespass, and when confronted by the landowner, he apologized and left the land.
I explained to Mr. Elalami that this was not a criminal proceeding, and that paying the fine would not result in creating a criminal record for him.
Mr. Elalami agreed to pay the fine, and not proceed any further with his appeal. He should send a check or money order for $50.00, payable to the "Department of Natural Resources" to the following address:

This is the end of this matter. I am, therefore, closing our file and returning the record to the Department for filing.
