RE: In the Matter of the Notice of Trespass Violation, Civil Citation and Imposition of Penalty Issued to Andrew Paul Ganfield; OAH Docket No. 6-2000-11506-2
Gentlemen:
A prehearing conference telephone call in this matter took place on February 20, 1998, among myself, Mr. Ganfield and Officer Jensen.
We discussed the facts of this situation, and there is no dispute about them -- they are essentially as set forth in Mr. Ganfield's letter of November 16. He was lost, he did not intentionally enter into another person's land, but he did so by accident. The landowner saw him and told him to leave. Mr. Ganfield attempted to leave, but because he was lost, he went the wrong way.
Unfortunately, Mr. Ganfield found himself in the middle of a multi-year dispute between two neighbors, and when the landowner learned that Mr. Ganfield was part of his neighbor's hunting party, he demanded that a citation be issued. Officer Jensen talked with all parties, determined the facts to be essentially as set forth above, and decided to write a civil citation.
Mr. Ganfield has decided not to pursue this matter any further, and is withdrawing his appeal. He has agreed that upon receipt of this letter, he will forward the $50.00 fine to the Department.
